a public meeting at 7:00 PM April 1, 2008
at the Sadsbury Township Municipal Building located at 2920 Lincoln
Highway, Sadsburyville, Pennsylvania to consider the enactment of the
following: AN ORDINANCE AMENDING CHAPTER 94, PARKS AND MUNICIPAL FACILITIES,
OF THE CODE OF THE TOWNSHIP OF SADSBURY BY REPEALING THE EXISTING CHAPTER 94
IN ITS ENTIRETY AND REPLACING IT WITH A NEW CHAPTER 94, WHICH SETS FORTH THE
RULES AND REGULATIONS FOR ACTIVE RECREATION PARKS AND PASSIVE PUBLIC PARKS
AND OPEN SPACE WITHIN SADSBURY TOWNSHIP AND THE PENALTIES FOR VIOLATION OF
THE PARK RULES. A summary of the proposed ordinance follows: SECTION I:
Amends Chapter 94 by repealing the existing Chapter 94 and replace it with a
new Chapter 94 summarized as follows: §94-1. Active recreation parks. Sets
forth the rules and regulations for all Township active recreation parks,
including but not limited to Bert Reel Park and Sadsbury Park. §94-2.
Passive public park and open space lands. Sets forth the rules and
regulations for all Sadsbury Township public parks and open space lands
currently in passive uses, including but not limited to Greenbelt Drive.
§94-3. Posting of rules and regulations. Sets forth the rules and
regulations described in §94-1 and §94-2 shall be posted at Township parks
and open space where the rules and regulations are applicable. §94-4.
Violations and penalties. Sets forth any person violating any one of the
rules and regulations set forth in this ordinance shall pay a fine not
exceeding $1,000 and/or shall be imprisoned for a period not more than 90
days per violation. A separate offense for violating the above described
rules and regulations shall arise for each day the offender violates a rule
or regulation and for each rule or regulation violated. SECTION II:
Effective five (5) days from enactment. The full text of the ordinance is

INVITATION FOR
BIDS THE CONSTRUCTION OF SANITARY SEWER EXTENSION PHASE 2B MORRIS LANE AND
LINCOLN HIGHWAY PHASE 3B STOVEPIPE HILL ROAD NORTH STREET AND OLD WILMINGTON
ROAD FOR SADSBURY TOWNSHIP, CHESTER COUNTY, PA. SEALED PROPOSALS will be
received at the Sadsbury Township Building, 2920 Lincoln Highway,
Sadsburyville, Pa. 19369 between the hours of 9:00 A.M. to 3:30 P.M. Monday

tax. Sets forth the duty and requirements of employers to collect and make
payment of the tax, prepare and file a return with the Local Services Tax
Collector; establishes the date the employer is to remit quarterly payments and
the use of employer's employment records to determine from whom the tax shall be
deducted; sets forth the collection and payment requirements for self-employed
individuals, persons and employers residing outside the Township and engaging in
an occupation within the Township, and individuals engaged in more than one
occupation. Provides for the pro-rate withholding of the tax. § 118-11.
Administration and enforcement. Sets forth the powers and duties of Tax
Collector; the imposition of a penalty and interest for late payment and
collection costs including attorney fees; establishing violations and penalties.
§ 118-12. Exemptions. Sets forth exemptions from the local services tax for
persons who receive Earned Income Tax and Net Profits of less than $12,000 per
calendar year from all sources in Sadsbury Township, persons who were
permanently disabled during military services and for persons called to active
duty in a Reserved Component of the Armed Forces. This section also authorizes
the Local Services Tax Collector to adopt regulations for processing exemption
claims. § 118-13. Refunds. Provides for the refunds of overpaid local services
tax and authorizes the Local Services Tax Collector to adopt rules and
regulations for the processing of refund claims by taxpayers. § 118-14.
Collection of Coatesville School District Local Ser vices Tax. Provides for the
Local Services Tax Collector to collect and pay to the Coatesville Area School
District the local services tax levied by the Coatesville Area School District
if the combined rate of the School District's and Township's tax exceeds $10.00.
SECTION 2. This Ordinance shall become effective on or after five (5) days after
enactment and shall apply to tax years commencing on or after January 1, 2008.
The revenues from the tax will be used for police, fire or emergency services,
road maintenance or real estate tax reduction purposes, as provided for under
the provisions of the Local Tax Enabling Act. The amount of revenue estimated to
be generated by the local services tax is $ $35,000 for the tax year 2008. A

Revenue of the Commonwealth of Pennsylvania to determine, collect, and enforce
the tax, interest, and penalties for delinquent tax payment. Section 6 . If any

unconstitutional, illegal or invalid, such decision shall not affect or impair

deducted; sets forth the collection and payment requirements for self-employed
individuals, persons and employers residing outside the Township and engaging in
an occupation within the Township, and individuals engaged in more than one
occupation. Provides for the pro-rate withholding of the tax. § 118-11.
Administration and enforcement. Sets forth the powers and duties of Tax
Collector; the imposition of a penalty and interest for late payment and
collection costs including attorney fees; establishing violations and penalties.
§ 118-12. Exemptions. Sets forth exemptions from the local services tax for
persons who receive Earned Income Tax and Net Profits of less than $12,000 per
calendar year from all sources in Sadsbury Township, persons who were
permanently disabled during military services and for persons called to active
duty in a Reserved Component of the Armed Forces. This section also authorizes
the Local Services Tax Collector to adopt regulations for processing exemption
claims. § 118-13. Refunds. Provides for the refunds of overpaid local services
tax and authorizes the Local Services Tax Collector to adopt rules and
regulations for the processing of refund claims by taxpayers. § 118-14.
Collection of Coates ville School District Local Ser vices Tax. Provides for the
Local Services Tax Collector to collect and pay to the Coatesville Area School
District the local services tax levied by the Coatesville Area School District
if the combined rate of the School District's and Township's tax exceeds $10.00.
SECTION 2. This Ordinance shall become effective on or after five (5) days after
enactment and shall apply to tax years commencing on or after January 1, 2008.
The revenues from the tax will be used for police, fire or emergency services,
road maintenance or real estate tax reduction purposes, as provided for under
the provisions of the Local Tax Enabling Act. The amount of revenue estimated to
be generated by the local services tax is $ $35,000 for the tax year 2008. A
full text copy of the ordinance is available for public examination without
charge or may be obtained for a charge not greater than the cost thereof at the

W, to include additional transactions excluded under 72 P.S. §8102-C.3. Section
3 . Amends § 118-32.2 to allow the Secretary of Sadsbury Township to prescribe,

enforcement of the provisions of this article; and incorporates the regulations
that have been promulgated by the Pennsylvania Department of Revenue under 72
P.S. § 1101-C et seq. Section 4 . Amends § 118-32.3.A to provide an interest
rate of the lesser of the interest rate imposed upon delinquent Commonwealth
taxes or the maximum interest rate permitted under the Municipal Claims and Tax
Liens Act for tax claims. Section 5 . Amends § 118-32.3 by adding subsection E,
which authorizes the Department of Revenue of the Commonwealth of Pennsylvania
to determine, collect, and enforce the tax, interest, and penalties for
delinquent tax payment. Section 6 . If any sentence, clause, section, or part of
this Ordinance be declared unconstitutional, illegal or invalid, such decision
shall not affect or impair any of the remaining provisions, sentences, clauses,
sections, or parts hereof. Section 7 . All ordinances or parts of ordinances
conflicting or inconsistent herewith are hereby repealed. Section 8 . This
Ordinance shall become effective and applicable to any document, made, executed
delivered, accepted or present for recording on or after five (5) days after
enactment. The revenues from the tax will be used in accordance with the
provisions of the Local Tax Enabling Act, for general services. The amount of
revenue estimated to be generated by the real estate transfer tax is $180,000

COUNTY SEALED PROPOSALS will be received by Sadsbury Township of Chester

following: Resurfacing of approximately 1,700 linear feet or 0.32 miles of
streets varying in width, including the placement of approximately 280 tons
of SuperPave HMA Wearing Course, 9.5mm Mixture, 1.5' min. depth, SRL 'H' and
370 tons of SuperPave HMA Binder Course, 19mm Mixture, 2' minimum compacted
depth. There is no milling involved with this project. All Bidders must be
prequalified by the Pennsylvania Department of Transportation. Bids will be
publicly opened and read aloud by the Township Secretary at 9:00 A.M.,
Tuesday August 21, 2007 at the aforementioned place. Specifications and

PUBLIC NOTICE
Notice is hereby given that JYF Partners has submitted a Sewage Facilities
Planning Module to Sadsbury Township. The applicant proposes to provide
public sewer and water service to the 12.56 acre project site known as The
Lafayette Square Land Development. This site will be served with public
sewer by Pennsylvania American Water Company Coatesville Waste Water
Treatment Plant and public water by Pennsylvania American Water Company.
This property is located on Old Wilmington Road, north of Business Rt. 30 in
Sadsbury Township, Chester County. The project consists of constructing up
to 125 individual multi-family residential units within a 13 building
layout. The daily anticipated wastewater flow calculation is estimated to be
29,250 gallons per day (gpd), resulting in 130 equivalent dwelling units
(EDU's) for the residential units. Public notice is required due to the
concerns of the Chester County Health Department, specifically the regarding
properties east of the proposed site. The Chester County Health Department
has recommended these properties be considered by Sadsbury Township during
the planning process. The proposed project has been designed to comply with
the local ordinance and it is consistent with County Planning Commission
policies regarding sewage facilities planning. Due to potential overload at
the treatment facility, the project has entered into a Connection Management
Plan with the Pennsylvania Department of Environmental Protection and the PA
American Coatesville Wastewater Treatment Facility to control the flow
reaching the plant. There are no potential conflicts with endangered or
threatened species located on this site, nor will this project encroach on
any special protection watersheds. A public comment period will extend for
30 days after the date of publication of this notice. The land development

of the Pennsylvania Department of Environmental Protection Rules and
Regulations require that public notice be given to allow the general public
to provide comments regarding a resolution of a consistency conflict between
a proposed development, known as Cowan Estates and primary agricultural land
policies and between this proposed development and, possibly, the Chester
County Comprehensive Plan Policy Element, Landscapes. In addition, the
Pennsylvania Historical and Museum Commission (PHMC) has indicated that a
high probability exists that archaeological resources may occur within the
proposed area. The developer has agreed to abide by all PHMC guidelines.
There may be other conflicts, which have not yet been identified, however,

the act of May 19, 1995, P.L. 4, No. 1995-2. notice is hereby given that
Marshall Geoscience, Inc., on behalf of Joseph DiSciullo (Owner), has
submitted to the Pennsylvania Department of Environmental Protection (DEP) a
Notice of Intent to Remediate (NIR) a site located at 18 Chestnut Street,
Sadsbury Township, Chester County. This Notice of Intent to Remediate states
that the site is a petroleum storage and distribution facility. The site has
been found to be contaminated with leaded gasoline constituents which have
contaminated subsurface soil and ground water at the site. The proposed
future use of the property will be maintained as a non-residential,
commercial site. Owner plans to demonstrate attainment of a combination of
the Statewide Health Standard and Site-Specific Standard for soil, ground
water, and vapor media at the site. The Act provides for a 30-day public
comment period for Site-Specific Standard remediations. The 30-day comment
period is initiated with the publication of this notice. Until April 29,
2007, Sadsbury Township may submit a request to the Owner to be involved in
the development of the remediation and reuse plans for the site. Sadsbury

that Valley shall provide all maintenance services to the forty-six foot
portion of the relocated Rockdale Drive within Sadsbury Township; and
WHEREAS , The Second Class Township Code, at 53 P.S. §66903 expressly
authorizes Townships of the Second Class to contract with any municipal
cooperation to secure the services within the Township of the maintenance of
the municipal corporation; and WHEREAS , the Act Relating to
Intergovernmental Cooperation, 53 Pa. C.S.A. §2301, et seq. , expressly
authorizes a Township of the Second Class to enter into a joint agreement
with Sadsbury Township in the exercise or performance of their respective
governmental functions, duties or responsibilities; and WHEREAS , the
Township desires to obtain the maintenance services described above, and
Township agrees to provide such services, pursuant to an agreement
materially consistent with proposed Roadway Services Agreement between the
Township of Sadsbury and the Township of Valley attached hereto as Exhibit

Sections 118-7.A., 118-9 and 118-10 to increase the amount of the tax from $10
to $52. SECTION IV: Effective five days from enactment. The substantial nature
of the tax to be approved is an increase in the Occupational Privilege Tax,
which by amendment will become the Emergency and Municipal Services Tax, from
$10 to $52. The reason for the increase in the tax is to offset the costs of
providing emergency and municipal services in the Township. The revenues from
the tax will be used in accordance with the provisions of the Local Tax
Enabling Act, including police, fire and/or emergency services; road
construction and/or maintenance; or for the reduction of property taxes. The
amount of revenue estimated to be generated by the increased tax is $40,000

the special public meeting. The proposed ordinance is titled as follows: AN
ORDINANCE OF SADSBURY TOWNSHIP AMENDING THE SADSBURY TOWNSHIP ZONING ORDINANCE
OF 2001, AS AMENDED, TO CREATE A NEW TRADITIONAL NEIGHBORHOOD DEVELOPMENT
OVERLAY DISTRICT PERMITTED BY CONDITIONAL USE ADJACENT TO THE SADSBURYVILLE
VILLAGE DISTRICT; BY ESTABLISHING THE CRITERIA FOR DEVELOPMENT WITHIN THE
TRADITIONAL NEIGHBORHOOD DEVELOPMENT OVERLAY DISTRICT; AND BY ESTABLISHING
STANDARDS FOR TRADITIONAL NEIGHBORHOOD DEVELOPMENT. A summary of the proposed
ordinance prepared by the municipal solicitor follows:
Section 1. Chapter 129, Article II of the
Code, "Definitions”, Section 201, "Definitions and Word Usage”, is hereby
amended to add the new definitions for "Civic Buildings”, "Cul De Sac”,
"Traditional Neighborhood Development (TND)” and "Tract Area, Gross”. Section
2. Chapter 129, Article III of the Code, "Establishment of Districts”, Section
302.B. "Overlay Districts”, is amended by adding the term "Traditional
Neighborhood Development (TND) Overlay District”. Section 3. Chapter 129,
Article XI of the Code, "Overlay Districts”, is amended by adding a new
Section 1107, to be entitled “Traditional Neighborhood Development Overlay
District”, to include the following summarized provisions: Section 1107.A.
defines a TND, and sets forth the purposes to be served by the TND overlay
district. Section 1107.B. authorizes the TND development provisions by
conditional use within limited areas adjacent to the SVD, which meet all of
the following qualifying criteria: Tracts that are located entirely within
4000 feet of the intersection of PA Route 30 and Old Wilmington Road; Tracts
that are west of Old Wilmington Road; Tracts that are south of PA Business
Route 30; Single or multiple tracts under common ownership as of the date of
the enactment of this Ordinance which are greater than 100 contiguous acres;
and Tracts that can be served by a public sewer disposal system and public
water service. Section 1107.C. provides that the standards for the overlay
zoning district are to be used as an option to the base zoning district
standards. When authorized as a conditional use, the regulations set forth in
this section shall supersede regulations otherwise applicable. Section 1107.D.
provides for administration of the ordinance by the Board of Supervisors
pursuant to Article VII-A of the Pennsylvania Municipalities Planning Code.
Section 1107.E. sets forth the TND requirements and options, including the
elements (uses) permitted by right, including single-family detached,
single-family attached (townhouses) and multi-family (condominiums); the
density of residential dwelling units, to be determined by multiplying the
gross area of the tract by 3.5; and the required mix and locations of the
types of residential dwelling units. Section 1107.F. sets forth the specific
area and bulk regulations for each type of residential dwelling units;
nonresidential uses including community facilities and civic buildings; and
accessory uses; building height; maximum impervious coverage; common open
space requirements (40% of gross tract area) and design standards. Section
1107.G. sets forth the specific design standards for a TND, including
requirements for lots; blocks; drainage; streets and alleys; curb cuts,
driveways and garages; sidewalks; common open space design standards;
screening and landscaping; building setback from pipeline utility easements;
residential buildings and neighborhood design; nonresidential building design;
parking and parking lots; and grading. Section 4. If any provision or part of
this Ordinance is held invalid, the remaining provisions or parts of this
Ordinance shall not be affected thereby. If the application of this Ordinance
or any of its provisions or parts to any persons, property or circumstances is
held invalid, the application of this Ordinance to other persons, property or
circumstances shall not be affected thereby. Section 5. This Ordinance shall
be effective five days from the date of enactment. The Board will consider the
following two amendments to the ordinance, as proposed, at the public hearing.
The Board will consider amending Section 1107.G.7.d.(1) to read as follows:
"Open space areas intended for passive use shall be permitted to include
stormwater management facilities only where designed, permitted, operated and
maintained as a (i) wet pond; (ii) subsurface facility; or (iii) another
facility that in the opinion of the Township engineer employs innovative best
management practices and is landscaped in a manner compatible with a TND.” The
Board will consider amending Section 1107.G.9. to read as follows: “A building
setback of at lease fifty (50) feet in width shall be established for all
pipeline utility easements or rights-of-way where: (i) the utility easement or
right-of-way is in excess of 100 feet in width; and (ii) the precise location
of the utility line can be determined through field survey.” A full text copy

PUBLIC NOTICE IS HEREBY GIVEN that the Board of Supervisors
of Sadsbury Township will consider enactment and passage of the following
amendments to the Sadsbury Township Zoning Ordinance and Zoning Map at its
regular public meeting on February 17, 2004, at 9:00
a.m., at the Township Municipal Building located at Ramsey Alley,
Sadsburyville, Pennsylvania. AN ORDINANCE OF SADSBURY TOWNSHIP AMENDING THE
SADSBURY TOWNSHIP ZONING ORDINANCE OF 2001 AS AMENDED BY AMENDING THE ZONING
MAP TO REZONE CERTAIN LANDS EAST OF ROUTE 10 AND NORTH OF ROUTE 30 AND BETWEEN
ROUTE 30 AND BUSINESS ROUTE 30 TO C-1 LIMITED COMMERCIAL FROM RR RURAL
RESIDENTIAL; BY ESTABLISHING SPECIAL SADSBURYVILLE VILLAGE DEVELOPMENT OVERLAY
DISTRICTS; BY DESIGNATING CERTAIN LANDS ALONG BUSINESS ROUTE 30 WITHIN SAID
OVERLAY DISTRICTS; AND BY ESTABLISHING STANDARDS FOR DEVELOPMENT WITHIN SAID
OVERLAY DISTRICTS.
Section 1. Changes the zoning of portions of certain
lands located east of PA Route 10 and north of PA Route 30, identified as tax
parcel numbers 37-1-25, 37-1-26.2, 37-1-26, 37-1-27 and 37-1-29, measured a
distance of two hundred and fifty (250) feet east from the center line of PA
Route 10 to a line running parallel to said center line as described more
specifically in the ordinance, and as shown on Exhibit A attached to the
ordinance, from the current designation of R-R Rural Residential to C-1
Limited Commercial.
Section 2. Changes the zoning of certain lands
located north of Business Route 30 and south of PA Route 30, identified as tax
parcel numbers 37-2-8.4, 37-2-8.2 and 37-2-9, as described more specifically
in the ordinance and as shown on Exhibit B attached to the ordinance, from the
current designation of R-R Residential to C-1 Limited Commercial.
Section 3. Amends Section 302.B. of the Zoning
Ordinance to add the Special Sadsburyville Development Overlay Districts to
the list of overlay zoning districts.
Section 4. Adds a new Section 1106 of the Zoning
Ordinance establishing the Special Sadsburyville Village Development Overlay
District.
Section 1106.A. sets forth the purposes and intent of
the overlay district.
Section 1106.B. provides that the overlay district
standards are supplemental to the underlying zoning district, and that the
overlay standards are to be used as options to the base zoning district
standards.
Section 1106.C. establishes three (3) development
overlay zoning districts. Development Overlay District 1 is the parcel located
on the south side of Business Route 30, between Hershey Lane and Quaker Road
identified as tax parcel number 37-3-2 and as shown on Exhibit C attached to
the ordinance. Development Overlay District 2 are the parcels located on the
south side of Business Route 30, between Quaker Road and Old Mill Road
identified as tax parcel numbers 37-3-12, 37-4-1 and 37-4-1.1 and as shown on
Exhibit D attached to the ordinance. Development Overlay District 3 are the
parcels located north and south of Business Route 30, immediately east of the
existing Philadelphia Electric Company transmission line right-of-way
identified as tax parcel numbers 37-4-17, 37-2-16, 37-2-15.3A and 37-2-16.1
and as shown on Exhibit E attached to the ordinance.
Section 1106.D. sets forth the qualifying conditions
for consideration of any tract for development under the overlay.
Section 1106.E. requires conditional use approval for
all uses and sets forth the standard for development in each overlay district.
District 1 allows residential cluster development with a gross density of no
greater than 1.5 dwelling units per acre and one or more office buildings
located no more than 300 feet from the Business Route 30. District 2 allows
residential cluster development with a gross density of no greater than 1.5
dwelling units per acre and one or more office buildings located no ore than
300 feet from the Business Route 30. District 3 allows office and/or retail
buildings located no more than 300 feet from the Business Route 30 and
residential cluster development south of Business Route 30 with a gross
density of no greater than 1.5 dwelling units per acre. A minimum of 50% of
common open space is required for all three districts. Design standards for
residential and nonresidential development are provided. Section 5. Effective
five days from the date of enactment.

NOTICE Pursuant to the Land Recycling and Environmental
Remediation Standards Act, the Act of May 19, 1995, P.L. 4, No. 1995-2 ("Act
2"), notice is hereby given that Brunswick Corporation has submitted a Final
Report to the Pennsylvania Department of Environmental Protection, Southeast
Regional Office, to demonstrate attainment of the statewide health and
site-specific standards for a site located at 110 Stewart Huston Drive,
Coatesville, Sadsbury Township, Chester County. Brunswick Corporation has
indicated that the remediation measures taken have attained compliance with
the statewide health and site-specific cleanup standards established under Act
2.

of Sadsbury Township will convene a public hearing at 1:00 P.M., on January
27, 2004, at the Sadsbury Township Municipal Building located at Ramsey Alley,
Sadsburyville, Pennsylvania, to consider the following application for
conditional use: No. C-1-03 Application of Cosmos Properties, L.P. for
conditional use approval pursuant to Section 1002.B.5 of the Sadsbury Township
Zoning Ordinance to permit the construction of a self-storage (mini-warehouse)
facility on the property situated southeast of the intersection of Lincoln
Highway (Business 30) and AIM Boulevard within the Bellaire Business Center.
The Applicant also requests conditional use approval pursuant to Section
1305.C.3. of the Zoning Ordinance, as amended by Ordinance No. 2003-06, to
authorize a reduction in the number of off-street parking spaces for the
proposed facility. The property in question consists of approximately 7.6
acres and is Lot 3 of the Bellaire Business Center. It is also known as tax
parcel no. 37-4-56.15. The property is located in the I-1 Light Industrial
